Maine’s Marijuana Testing Rules In Effect

In September 2019, the Department of Administrative and Financial Services (“DAFS”) issued emergency rules governing the certification of marijuana testing facilities and testing of marijuana and marijuana products. The rules went into effect immediately, but marijuana testing will only be mandatory for adult use marijuana and marijuana products under the current legal framework. While a public comment period will be provided before the emergency rules are adopted on a more permanent basis later this fall, we do not anticipate major changes. If any meaningful changes are made in the final adoption of the rules, we will post an update.

The Office of Marijuana Policy is not currently accepting applications for marijuana testing facility certifications, but the initial application form is available for review on OMP’s website.   OMP also posted a sample chain of custody form and information sheets for prospective testing facility applicants.
